Workplace Employment Agreements and Workplace Policies

Most of an employee’s rights are set out in the Fair Work Act, or an Award. This includes what they are supposed to do, what hours they are to work and where, what leave they can take, and what they should be paid.

But what about the employee’s obligations? What about the employers’ rights? These are not found anywhere else. An employer is left to their own devices!

This is where the team at ALG step in. We listen carefully to learn about your business. We learn about your employees, and what they do. We learn about your business needs, and how to protect it.

We produce to you an Employment Agreement that balances out the rights and obligations of employee and employer. It will set the expectations of each party. Without it:

  • An employer has no right to set off overpayments against underpayments, or to require time in lieu be taken instead of paying overtime.
  • An employer has no right to make deductions for equipment or uniform damage.
  • An employee has no obligation to perform to a certain standard or complete certain duties, which makes performance management and disciplinary processes difficult.
  • An employee has no express duty to protect an employer’s information, customer lists, processes, or intellectual property, which makes it difficult for an employer to complain when things go wrong.

Setting a mutually agreed written understanding helps to avoid disputes and ensure a long-term beneficial relationship for all parties. Further, as you can imagine, the above dot points are just a few of the significant advantages that an employer can obtain which are otherwise not available.
