Employment Law

Bullying, Harassment and Discrimination

Bullying, Harassment and Discrimination all involve one thing – poor workplace culture. As an employer, you should have strong policies aimed at preventing these things, and strong disciplinary processes to follow should someone not tow the company line.

Bullying and Harassment

As an employee, there is a difference between reasonable performance management action, and bullying and harassment.

When you are persistently excluded for work things, when your work is sabotaged, when you are not given the tools or training you need to carry out a direction or part of your role, you can speak up. This is bullying and harassment.

When you are ridiculed, belittled, teased, humiliated, intimidated, pressured to do something wrong, or given too much work, your rights are being affected and you can speak up. This is bullying and harassment.

Discrimination

We are all different. Most of us are getting better at accepting us for who we are. Most of us enjoy being different and being around people who are different.

Discrimination is when someone treats someone else differently because of their age, race, colour, sex, sexual preference, religion, political opinion, marital status, disability, or carer’s responsibilities. It can happen during recruitment, before work commences, or at any time during employment.

However, discrimination is not when someone treats someone else differently because of the inherent requirements of a job. It is a fine line which is often confusing.

Our team at ALG listens to your circumstances and provides an early initial opinion of whether there has, may have been, or indeed has not been or has unlikely to have been, conduct that is Bullying, Harassment or Discrimination.

Contact Access Law Group today to find out whether you may have a claim, risk a claim being brought against you, or have grounds to defend a claim.
